Personal data protection

Since the entry into force of Directive 95/46/EC of October 1995, LJLex has been providing advice on protection of personal data both to Italian and foreign companies and to public bodies. The advice we provide includes, in particular, the following areas: adaptation to the GDPR, assisting controllers and processors in drafting internal documentation, maintaining records of processing activities under their responsibility, identifying and designating a data protection officer. We provide an expansive range of services and regularly represent our clients in proceedings before the Italian Data Protection Authority (Garante per la protezione dei dati), as well as in proceedings before the Ministry of Economic Development and before the Authority for Communications Guarantees (l’Autorità per le Garanzie nelle Comunicazioni), with regard to telemarketing and direct sales to consumers. We also assist our clients in the event of a complaint lodged with the Italian Data Protection Authority or with the court, as well as in case of investigations or sanctioning proceedings commenced by the Italian Data Protection Authority or by other European Authorities, such as the Bundesnetzagentur, the Österreichische Datenschutzbehörde, the Commission Nationale de l’Informatique et des Libertés, the Information Commissioner’s Office.

Intellectual Property – Information Technology – Food and wine regulatory

LJLex has a strong technical expertise in advising on protection, enforcement and exploitation of the whole range of IP rights. Clients benefit from our industry-specific skills and extensive experience in both non-contentious and contentious IP matters. We have advised on how to establish, strengthen and protect the IP assets of a business. In particular, we provide legal assistance in a variety of IP related agreements including joint ventures, collaborative research and exploitation, outsourcing, licensing and technology transfer agreements, franchising transactions, as well as in copyright issues.

We advise food manufacturers, syndicates and wine makers on the full range of regulatory issues and on all aspects of product specification, labelling, distribution and license agreements.

We also offer legal and tax advice in the field of art and cultural heritage law to Italian and foreign collectors, investors, companies, foundations, associations, archives, institutions and artists.

EU and international law

Our firm has solid experience in providing legal advice on the effects of the EU law on domestic and cross-border commercial transactions, with particular attention to the EU rules on competition and state aid. We provide also legal advice on all aspects of international law.

Litigation and Arbitration

LJLex handles corporate, commercial and intellectual property disputes and assists its clients in arbitration proceedings both on national and international level. In cross-border disputes our firm avails itself of its strong contacts with highly qualified professionals practicing law in other jurisdictions.

Real Estate and Trust

LJLex assists Italian and foreign-domiciled individuals, families and businesses in all aspects related to real estate, trusts and inheritance law. Our major areas of practice include advising trustees and shareholders on transfer of family business, advising foreign nationals on managing assets, purchasing property and doing business in Italy. The LJLex’s trust and real estate team assists trustees and other parties in drafting wills, establishing and managing trusts, and represents them in the related contentious matters.

LJLex has a very strong tax law and accounting department, where we provide legal advice and services on all matters related to income tax, balance sheets, tax law and tax cases.
